Scope of services

Rustjack Systems (a service mark of BuccaneerSalvage, operated by Cap'n Jules the Rustjack, Carbondale PA 18407) provides the following services to eBay sellers:

  • Custom eBay listing HTML templates, designed to client specifications
  • Item Specifics population and SEO-friendly title generation
  • Vehicle fitment research (auto parts) and product specification research (other categories), drawing from official distributor catalogs, manufacturer data sheets, and curated cross-reference databases
  • Bulk listing pipelines: spreadsheet or batched pushes, with a dry-run first and a check after they land
  • Listing audits, compliance review, and on-page fixes
  • OAuth account access (read+write) to a seller's eBay account, granted voluntarily and revocable at any time
  • Web design and site-building for sellers who also want a Squarespace / Shopify / static-HTML storefront alongside their eBay presence

Every engagement begins with a written scope agreement (email is sufficient) that defines deliverables, fees, and timeline. Work outside that scope requires a new agreement.

No guarantee of results

We do not promise any specific commercial outcome. Improved design, accurate data, and listing compliance may improve visibility, conversion, or search rank, but we will never guarantee they will.

Specifically, we make no representation, warranty, or guarantee of any kind with respect to:

  • Sales volume, conversion rate, or revenue from any listing, store, or account we touch
  • Search rank, click-through rate, impression share, watch count, BSR, or any other Cassini / eBay algorithm metric
  • Buyer behavior, dispute outcomes, return rates, defect rate, or account standing
  • Specific time-to-rank, time-to-first-sale, or any other temporal projection
  • Whether any particular change will be net positive versus no change at all
You are responsible for the results of your store. Our role is to provide design, data, automation, and audit services to a high professional standard. Market outcomes depend on factors outside our control, including eBay algorithm changes, category competition, buyer demand, item condition, shipping speed, and pricing.

Third-party data and research

Research is sourced from publicly available third-party sources, including (where applicable to your category) official manufacturer catalogs, distributor fitment databases, and OEM data sheets. We apply provenance rules to weigh source quality, and we never paste raw scraped HTML into a deliverable. All trademarks and catalog data remain the property of their respective owners; references describe sourcing methodology only and imply no affiliation or endorsement.

We do not warrant the accuracy, completeness, or fitness for any particular purpose of third-party data. The seller is responsible for verifying fitment, dimensions, weight, materials, and any other data before publishing a live listing. We provide research as a working draft, not a certified specification.

If a research source returns bad data and that bad data appears in a deliverable we produced, our liability is limited to replacing the affected data on the same deliverable at no additional charge. We do not refund the project on the basis of a single data point, and we are not liable for downstream losses (lost sales, returns, defects) caused by bad data from a third-party source.

eBay platform changes

eBay is a third-party platform. eBay may, at any time and without notice, change its HTML policies, active content rules, category requirements, listing fields, fee structure, Top Rated Seller thresholds, Cassini algorithm, or any other term of service.

We are not responsible for changes eBay makes after a deliverable is published. If eBay updates its active-content policy and a previously-passing template becomes non-compliant, the seller is responsible for updating the listing or commissioning a new template at then-current rates.

No refunds are offered on the basis of eBay-side changes. This includes, without limitation, removal of custom HTML support in a category, changes to the Item Specifics schema, deprecation of compatibility table fields, or any other platform change that affects a previously-delivered listing.

Client responsibility

You are responsible for:

  • The accuracy of source data you provide (part numbers, photos, dimensions, descriptions, condition reports, retail prices)
  • Reviewing every deliverable before going live. Drafts are drafts until you approve them
  • Compliance with eBay's user agreement, including prohibited items, authenticity requirements, and category-specific rules
  • Pricing decisions. We may provide comps, but the final price is your call
  • Returns, customer messages, defect handling, and all seller-side operational work
  • Maintaining your own backups of source materials (photos, product notes, MPN lists). We are not a long-term archive
  • Tax obligations, business licensing, and any required disclosures in your jurisdiction

OAuth account access

If you grant us OAuth access to your eBay account:

  • You retain full ownership of the account, all listings, and all data
  • You may revoke access at any time from your eBay account settings. We lose the ability to push changes the moment you do
  • Every change we make is logged via the Trading API's ReviseFixedPriceItem / AddFixedPriceItem audit trail, recoverable from your eBay seller hub
  • We will never change store policies, payment information, or payout details. Those are off-limits regardless of scope
  • We will never close or pause listings without your explicit, written approval (per-message basis, not blanket)
  • If you ask us to push bulk changes, we will always show you a dry-run report first unless you waive that in writing for a specific batch
You are responsible for reviewing every change we make. If a Revise or Add call lands and you do not like the result, contact us within 7 days and we will fix it free of charge or roll it back.

Payment and refunds

Payment processor: Square. We accept major credit cards via Square Checkout. You do not need a Square account. Maintain $29/mo and Partner $59/mo are billed from the subscribe buttons on the service page. One-offs use Square payment links.

Current public rates live on the service page. If a quote and the page disagree, the written quote for that job wins.

One-off work (text listing, styled listing, store review + fixes, web design, catalog batch): pay through Square on the service page. After payment clears, send photos, part numbers, or your store URL through Contact. Work begins after that message lands.

Monthly work. Maintain $29/mo is billed through Square on subscribe, then monthly (card on file). Cancel anytime. Partner $59/mo is billed in full through Square on subscribe, then monthly (card on file), same as Maintain. Cancel anytime; you pay for work already delivered. Unused listings from that month roll one more month, capped at that month's unused allotment. Pause 30 days, once per 6 months, per the service page.

Turnaround / handling. Single text or styled listings and store-review reports: 1–2 business days after payment and after we have what we need (photos, part numbers, or store link). Monthly plan work is paced weekly within the month. eBay-reject rewrites on plan work: about 1 business day. Large multi-batch jobs may take longer; we say so up front.

Refund policy:

  • Before any work begins: full refund
  • After a draft is delivered but before final approval: 50% refund of the project fee if cancelled at the draft stage
  • After final approval: no refund. Further work (revisions, additional listings) is billed at the then-current rate
  • If we fail to deliver an agreed scope within a reasonable timeframe, full refund or credit at your option
  • No refunds on the basis of eBay platform changes, third-party data inaccuracies, or unmet commercial outcomes (see Sections 02, 03, 04)

Intellectual property

What you own: The final approved deliverable. Once paid for, you have a perpetual, non-exclusive, non-transferable licence to use the templates, listings, designs, and data we produce for you across your own eBay account, web presence, and marketing.

What we retain: The underlying design system, code libraries, automation scripts, and methodology. You may not resell, redistribute, or sub-licence the templates as a product to third parties.

What you provide: You retain ownership of all source materials (photos, brand assets, MPN data, product descriptions) you share with us. You grant us a non-exclusive licence to use those materials solely for the purpose of the engagement.

Limitation of liability

Our total liability for any claim arising from an engagement is capped at the fees you actually paid us for that engagement.

We are not liable for:

  • Indirect, consequential, incidental, or punitive damages
  • Lost profits, lost revenue, lost data, lost business opportunity
  • Loss of eBay account standing, defects, or Top Rated Seller status
  • Buyer disputes, returns, chargebacks, or PayPal / eBay Money Back Guarantee claims
  • Actions of any third party (eBay, Square, your hosting provider, your supplier, your carrier)
  • Damages from changes to eBay's policies, search algorithm, or platform that occur after a deliverable is published

Nothing in these terms excludes liability for fraud, death, or personal injury caused by negligence, or any other liability that cannot be excluded under applicable law.

Termination

Either party may terminate an engagement at any time by written notice (email is sufficient).

On our side, we may terminate if:

  • Payment is more than 14 days past due
  • You request work that violates eBay's user agreement or applicable law
  • You are abusive to us or our contractors in any communication channel

On your side, you may terminate at any time. If you terminate, you pay for work already delivered. The OAuth token (if any) is revoked and we lose access immediately.

Disputes and governing law

These terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws provisions.

Any dispute arising from an engagement will first go through informal negotiation by email. If that fails, the dispute will be resolved in the state or federal courts located in Lackawanna County, Pennsylvania. Both parties consent to that jurisdiction.

If any provision of these terms is held unenforceable, the rest remain in effect.

Changes to these terms

We may update these terms from time to time. The "Effective" date at the top of the page reflects the most recent version. Material changes will be communicated by email to active clients. Continued engagement after a change constitutes acceptance.
